However, you may view, download for caching purposes only and print pages from the website for your own personal use, subject to restrictions set out in these terms and conditions.

It must be acknowledged by yourself, that we cannot be held liable in respect of this website or its content. We endeavour to ensure that all information provided on this website is correct, however, because we are an e-commerce store, product information (including images and features) are subject to change. We do our utmost to ensure that all product information is up to date.
Many of the products we offer on www.thebirdloftshop.com are covered by manufacturer’s warranties and although we will assist all customers who make use of these warranties, we cannot be held responsible for any problems that may occur as a result of purchasing a product, where the problem cannot be directly related to ourselves.
We will not be held responsible for any direct or indirect loss or damage arising in connection with our website. These damages include but are not limited to, loss of profit, contracts, business or data.

They do not represent an exhaustive source of information, and although we make every effort to ensure that the information and opinions expressed on our website are accurate, we cannot be held liable for any problems with birds or their setups resulting from information gained from this site. It is the customers’ responsibility to research the care requirements of their birds thoroughly and to ensure provision of the correct conditions for said birds.

Law and Jurisdiction: This notice will be governed by and construed in accordance with English Law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.
Privacy Policy / the Data Protection Act 1998: We are committed to safeguarding the privacy of all our website visitors through the implementation of The Data Protection Act 1998. Although we may collect data from the customer as part of the order process, we will never share these details with any third party unless previously agreed by yourself. Any personal data we collect from the customer, including email address, telephone number or name, will be used by ourselves to fulfil your order, send invoices and our own marketing communications. If you do not wish to receive any further marketing communications from us, you may contact us at any time to be removed from our marketing contact list.
Security: All payment information submitted to our site is handled through a secure interface and all of our information is stored on a secure server. The Bird Loft does not at any point store customer card details on our server, or anywhere else, unless requested to do so by the customer.
Third Party Websites: This website may contain links to third party websites. We are not responsible for the privacy policies, content or practices of third party websites.
Pricing and Sales: Orders are accepted for worldwide shipping, but The Bird Loft reserves the right to restrict shipment of products at their discretion due to weight, size, material e.g. glass and customs regulations.. Placement of a telephone order constitutes acceptance of these terms and conditions.
All prices on our website are inclusive of VAT but exclusive of delivery charges. The total price for the goods and delivery on your order will be stated at the time of order (unless excess delivery charges are required – applies to certain areas).
We are entitled to adjust our prices at any time including the change in price being due to an error or omission in the price published for the goods. If this occurs we will notify you of the correct price and give you the chance to cancel your order. All goods remain the property of The Bird Loft or their Agents until full payment is made and goods are delivered to the customer.
All payments made through the PayPal service are made using GBP, US dollar or EUR currency. We accept the following methods of payment via our website: MasterCard, Visa, Maestro, Electron. In all cases payment must be received in full before goods will be dispatched.
Delivery: We aim to deliver all orders within 3-5 working days of purchase. However, for items that are not currently in stock the delivery time may sometimes be longer. If your goods are not received within 10 days, please contact us.
All goods must be checked for damage and missing items upon delivery. Any damage or missing items must be reported to us within 24 hours of receipt of goods.
The Bird Loft offer free delivery of dry goods to most of the UK on orders of £55.00 and over, with the exception of bulk seed orders, cages and similar. Orders under £55.00 will incur a delivery charge of £4.99. Some postcodes will incur an extra delivery charge. We will contact you by telephone or email after you have ordered if additional charges will apply.
Orders to Europe and the EU will incur a minimum tracked delivery cost of £19.50 in all cases, the USA and Canada £29.50 will apply and the Rest of the World £36.50.
Orders for frozen food and live food can only be accepted for mainland United Kingdom and will be sent by courier for dispatch on a guaranteed timed service. In the event of a live food and frozen food delivery not having arrived by 4pm on the agreed day, customers are obliged to inform us of the problem with delivery immediately by telephone or email. Failure to inform us of a delayed delivery of live food or frozen foods by this time could invalidate any guarantee of safe arrival of live/frozen goods, and customers could not be entitled to a replacement of their order. The Bird Loft denies any liability for any loss resulting from damaged or faulty items, or late delivery.
We will despatch your goods by the most appropriate method. This may be by Royal Mail, Courier or direct from the wholesaler. We will ensure that your goods are correctly packaged before despatch but cannot accept liability for damage sustained by their subsequent treatment. Delivery of your parcel will be attempted once. If a delivery of dry goods cannot be made the parcel will be returned to the sorting office/courier’s depot for collection by yourself. Customers who refuse to accept a delivery will be entitled to a refund of the items’ purchase price once it has been returned to The Bird Loft in good condition: however, in such circumstances The Bird Loft will be entitled not to refund the shipping cost paid by the customer in the initial transaction. Frozen foods are sold subject to availability. Orders will be despatched on the basis of first come first served.
Frozen foods will be packaged to arrive still frozen. It is the responsibility of the customer to ensure that somebody is available at the delivery address to receive a frozen food order. The Bird Loft accepts no responsibility for frozen food orders which are defrosted/spoiled because nobody was available to receive the delivery. In the unlikely event that your frozen food order does not reach you in satisfactory condition contact us within 24 hours of receipt. We cannot replace or exchange any frozen food reported back to us after this 24 hour period. We reserve the right to postpone delivery of any frozen food or live food orders which are placed during extreme weather conditions e.g., flood, deep snow, heat wave.
Delivery of live foods will usually result in next day delivery, but this cannot be guaranteed. If you wish to have your live foods delivered by special delivery, please contact us before placing an order. Special delivery will incur an extra cost. We reserve the right to postpone live food deliveries if the overnight temperatures are not favourable.
Returns: The Bird Loft’s returns policy does not affect your statutory rights. If you wish to return all/part of your dry good order within 30 days of receipt, please contact us at sales@thebirdloftshop.com or telephone: 07933 479528. Returned products must be in perfect condition.
The Bird Loft will send you an email authorising you to return the goods. No goods will be accepted prior to the customer receiving an authorisation email. This email must be printed and retained as proof of authorisation for the return of goods.
Our returns address is: The Bird Loft, Unit 5, Waveney Valley Business Park, Falcon Lane, Ditchingham, Bungay, Norfolk NR35 2JG. The products being returned must be well packaged to avoid damage. We recommend returning the products by a signed for delivery service together with proof of postage. The Bird Loft will not accept that goods have been returned by a customer without proof of delivery to us or a receipt from a carrier. When products have been returned to The Bird Loft in good condition we will issue a full refund for the products only. We will not pay the cost of your returned postage unless a product is faulty.
Return of goods after 30 days is at the discretion of The Bird Loft. Products guaranteed by a manufacturer can be returned to us, if they are faulty, for exchange or refund during the warranty period. All products will be tested upon return. Bespoke goods and perishables i.e., magazines, books, parrot cages/stands and pigeon/chicken housing etc cannot be returned for refund unless faulty or damaged and in all cases notified within 7 days of receipt. In circumstances involving international sales, where products are either returned by customs or the customer, a refund will be given for the item/s only and not the original postage paid.
Under the Consumer Protection (Distance Selling) Regulations 2000, you have a duty to take reasonable care of any goods you receive. Under circumstances where this duty has been breached by yourselves, you will be liable for any costs or losses incurred by The Bird Loft.

WEEE Regulations: The ‘Waste Electrical and Electronic Equipment Directive (WEEE Directive) ‘was introduced in January 2007 by the Waste Electronic and Electrical Equipment Regulations 2006 and subsequently updated. The WEEE Directive aims to reduce the amount of electrical and electronic equipment being produced to encourage everyone to reuse, recycle and recover it. The Bird Loft is obliged therefore to offer customers free disposal of their WEEE when they purchase a similar new electrical or electronic product. Customers must forward their old WEEE item to us within 14 days of purchasing their new item. Items can be posted back to us, but we will not accept returns of WEEE without a copy of the receipt or invoice for the similar purchased item
